RESERVATION TERMS & CONDITIONS

1. Overview

 

Lumina Retreats and the website www.luminaretreats.com belongs to Luminary Life Joint-Stock Company (hereinafter referred to as “Luminary” or “Lumina Retreats”). Luminary is in the travel and leisure business and, as part of the services it provides to its customers, it runs transport, accommodation, excursions, tours and organize activities, classes, programs, workshops and health and physical activities.

The information within our website, brochures and other marketing material has been compiled with care and is provided in good faith. However, it is subject to change and does not form part of the contract between the customer and Luminary. When making a reservation with Luminary you agree in full to the following conditions.
 

2. Quoted Prices

All prices quoted are subject to change due to fluctuations in the exchange rates or additional government fees, which may be imposed at any time. 

3. Payment & Confirmation

Upon making your reservation our team will follow up within 24 hours working via email with an invoice and link to our secure online payment provider OnePay and our bank account details for bank transfer payment. 

Please review your invoice and the payment link to ensure they match the services booked and submit your payment. You will have 72 hours to make payment, otherwise your reservation will be canceled. You can make payment via Visa or MasterCard in Vietnamese Dong. A booking processing fee of 3% applies to online payment via OnePay.

4. Cancellations

Cancellation requests must be in written form via email to Luminary reservation department (email address: info@luminaryretreats.com).

4.1. For join-in tours

  • For cancellation made 15 days prior to tour start date or earlier: No cancellation fee.

  • For cancellation made within 8-14 days prior to tour start date: cancellation fee of 25% of the total tour price.

  • For cancellation made within 4-7 days prior to tour start date: cancellation fee of 50% of the total tour price.

  • For cancellation made within 3 days prior to tour start date or No-show: cancellation fee of 100% of the total tour price.

  • If the tour is delayed by Luminary due to government restrictions related to Covid-19, guests can choose either to postpone their reservations or receive a refund of 90% of the total tour price.

Special Cancellation Policy for 2022: We guarantee a stress-free, flexible booking policy for all 2022 tours. 100% refund of the total tour price for any Covid-related travel restrictions imposed by the government or Covid-related tour cancellations

4.2. For private tours and group tours

  • For cancellation made 15 days prior to tour start date or earlier: cancellation fee of 25% of the total tour price.

  • For cancellation made within 8-14 days prior to tour start date: cancellation fee of 50% of the total tour price.

  • For cancellation made within 7 days prior to tour start date or No-show: cancellation fee of 100% of the total tour price.

4.3. Resale

Luminary strictly prohibits the resale of any of our tour products under any circumstances. If you are found reselling our tour products, Luminary reserves the rights to cancel your booking of both you and whoever you sell the tour to, without refund, with no exception. This applies to both independent bookings, group bookings and private bookings.

4.4. Midway Cancellations

If for any reason you are declined to participate in the program or if you must quit the program midway, all tour costs will be forfeited without further compensation. Our guide and management reserve the right to decide if someone needs to be declined at any time if they feel someone poses a safety threat to themselves or others.

4.5. Cancellation due to force majeure events

In case of, the force majeure events e.g. natural disasters, storms, floods, earthquakes, fires, wars, terrorism, disease. Luminary is taking it right to unilaterally cancel its services. Luminary will process the refund of 100% of the portion of the tour value that the customer has paid and have not utilized at the time of cancellation. Luminary will not hold the responsibility for related costs (e.g. travel expenses, air tickets, hotel room booked etc.).

5. Amendments

5.1. For join-in tour

Written service change amendments or written departure date amendments are acceptable at least 8 days before the original departure date without additional costs (subject to availability and price difference surcharge if any). 

Written service change amendments or written departure date amendments are not accepted if the notification is within 7-day prior to departure date. 

5.2. For private tours and group tours

Written service change amendments or written departure date amendments are acceptable at least 15 days before the original departure date without additional costs (subject to availability and price difference surcharge if any). 

Written service change amendments or written departure date amendments are not accepted if the notification is within 14 days prior to departure date. 

6. Compensation

Should Luminary deem it advisable to amend an itinerary, it may do so by varying or completely rerouting any trip. In this case the traveller will make no objection or claim for compensation from Luminary. Compensation should be made through your insurance company.

7. Passport/ID

All customers must hold a valid passport and valid visa (or national ID card for Vietnamese citizen travelling on tours in Vietnam). It is your responsibility to obtain a current Vietnam visa. All passports and visas must be presented upon arrival at Luminary office. A photocopy will be made in our office and provided to local police for registration before accessing any area that we conduct tours.

8. Responsibility

A very high level of care is taken to ensure suppliers maintain high standards. However, as we do not operate transfer services, hotels/home-stays or restaurants, and we cannot be responsible in any way or problems resulting from the booking, unless it is a direct result of negligence on our part or part of our employees.

9. Tour Departure

All tours require a minimum number of guests to depart, and your booking will not be confirmed if the minimum number of guests is not reached. Luminary reserves the right to cancel any tour should the group size fall below the minimum numbers required. Alternative dates will be made available. Should this option be unacceptable, a full refund of all payments will constitute full settlement.

10. Tour Guide Authority

Luminary’s guides/staffs/management reserve the right to decline, accept, or retain any person as a member of any group at any time. Travelers must accept the authority of the tour guides, staffs on tour and follow our rules of to avoid causing danger to themselves or others. Luminary will not accept responsibility or liability for any traveler who contravenes any law or regulations of Vietnam.

 

11. Nature of Our Tours

It is a fundamental condition that you acknowledge that the nature of tour operations require some flexibility on your part as the itinerary may change due to any number of reasons including safety, weather, etc. The day-to-day itinerary is to be taken as a guideline only and not a contractual obligation. Luminary will not be responsible for any costs associated with booking alternative travel arrangements, flights, visas etc. if there are delays to the scheduled tour.

12. Minimum and maximum Age

Minimum and maximum age requirements (if any) will be advised depending on the tour program booked.

 

13. Travel Insurance & Risks

The tour price does not include a travel insurance and insurance for the risk of tour cancellation, risks that occur before/after the tour, or outside our tour operated area.

We encourage every traveler to purchase a comprehensive travel insurance package covering medical treatment, natural disasters, personal accidents, medical evacuation, etc. 

You understand that during the course of the trip certain events may occur such as accidents or illness in a remote location without medical facilities. You agree to assume all risks and hold Luminary blameless on all accounts of accidents or illnesses which arise during and after the tour (if any).

 

14. Good Faith

All information and advice provided either directly or via email related to vaccinations, climate and weather, visas etc. is given in good faith but Luminary takes no responsibility for the accuracy of this information.

 

15. Health and Fitness Level

It is vital that participants with pre-existing medical problems or conditions make these known to Luminary. If we discover that you have a medical condition which you have not disclosed to us (particularly a condition which would affect you on tour) or if you lie on your medical form in any manner, we reserve the right to cancel your tour without refund at any time. If your medical status changes at any time after you sign up, it is your responsibility to inform us immediately. Medical and evacuation expenses are the responsibility of the participant. It is important that you consult your doctor regarding vaccinations and other medical requirements before you depart. If you cannot complete any section of the tour due to lack of physical ability you will be declined to continue or participate at your own cost.

 

16. Alcohol and Drug Use

Neither excessive alcohol consumption (as determined by our guide/staff on tour) nor recreational drug use will be permitted on tour. If you are found to be drinking heavily, a member of staff will ask you to slow down. If you continue to consume alcohol irresponsibly and pose a safety risk to yourselves or others, you may be removed from the tour at the discretion of your guide team. We have a strict no-tolerance policy for recreational drug use. Anyone who is turned around for the above reasons will forfeit all tour costs and Luminary will not be responsible for any additional costs incurred by the participant.

 

17. Privacy

Luminary respects your privacy. We will only collect personal information that is relevant to your travel arrangements. We will protect the privacy of the information you provide us and only pass it to third parties such as hotels and local authorities when that information is necessary to fulfill your travel arrangements. In providing this information to us, you consent to Luminary using this personal information for the purpose of making and completing arrangements with related services.
